4. The Service: AI Image Generation

Functionality: Our Service allows you to provide text-based inputs ("Prompts") to our Artificial Intelligence system to generate images ("Generated Content").

 

User Responsibility: You are solely responsible for the Prompts you provide. You agree not to use Prompts that are unlawful, obscene, defamatory, or that infringe upon the intellectual property rights of any third party.

 

Nature of AI Content: You acknowledge that AI-generated content can be unpredictable. The Generated Content is created by an algorithm, and we do not guarantee its accuracy, uniqueness, or suitability for any particular purpose.1

 

5. User Conduct and Prohibited Content2

As per the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree not to host, display, upload, modify, publish, transmit, store, update or share any information that:

  • Belongs to another person and to which you do not have any right;

  • Is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;

  • Is harmful to a child;
  • Infringes any patent, trademark, copyright or other proprietary rights;
  • Violates any law for the time being in force;
  • Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
  • Impersonates another person;
  • Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
  • Contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any compu8ter resource;
  • Is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.

6. Intellectual Property Rights

  • Our IP: All rights, title, and interest in and to the Service itself (including our brand, logo, and the underlying AI technology) are and will remain the exclusive property of www.7similar.com.

  • Your Generated Content: You own the rights to the specific Generated Content you create using the Service. You grant www.7similar.com a worldwide, royalty-free license to use, reproduce, and display this content solely for the purpose of operating and providing the Service to you.

  • Responsibility for Prompts: You warrant that your Prompts do not infringe on the copyright, trademark, or other intellectual property rights of any third party.

 

7. Personal Data and Privacy

We are committed to protecting your privacy. All personal information you provide, including your Name, Phone Number, Email, and Photo, is collected, stored, and processed in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDP Act). By using our service, you consent to such collection and use of your data.

 

8. Payments and Refunds

  • Payments: We use UPI, a third-party payment gateway, for processing all payments. We do not store your credit/debit card details or other sensitive financial information on our servers. By making a payment, you agree to be bound by Razorpay's Terms of Service.

  • No Refund Policy: All purchases made on www.7similar.com are final and non-refundable. We do not offer any refunds or credits for any reason. Please ensure you are certain about your purchase before proceeding with payment.

 

9. Grievance Redressal Mechanism

In accordance with the Information Technology Rules, 2021, we have a grievance redressal mechanism.

To the maximum extent permitted by applicable law, www.7similar.com shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your access to or use of, or inability to access or use, the Service.

 

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on this site. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
